Privacy Disclosure
Effective February 2007

NOTICE OF YOUR FINANCIAL PRIVACY RIGHTS

We, our, and us when used in this notice, mean First California Bank.
This is our privacy notice for our customers. When we use the words "you" and "your" we mean the following types of customers:

  • Our consumer customers who have a continuing relationship by purchasing or holding financial products or services such as:
    • Deposit account
    • Loan account
    • Credit card account
    • Safe deposit box
    • Retail installment contract we hold and service
    • Self-directed Individual Retirement Account

We will tell you the sources of the information we collect about you. We will tell you what measures we take to secure that information.

We first define some terms.

Nonpublic personal information means information about you that we collect in connection with providing a financial product or service to you. Nonpublic personal information does not include information that is available from public sources, such as telephone directories or government records. Hereafter, we will use the term "information" to mean nonpublic personal information as defined in this section.

An affiliate is a company we own or control, a company that owns or controls us, or a company this is owned or controlled by the same company that owns or controls us. Ownership does not mean complete ownership, but means owning enough to have control.

A nonaffiliated third party is a person we do not employ or a company that is not an affiliate of ours. This is also known as nonaffiliated third party, or simply, an "other party".

THE INFORMATION THAT WE COLLECT

We collect information about you from the following sources:

  • Information you give us on applications or other forms
  • Information about your transactions with us
  • Information about your transactions with other parties
  • Information from a consumer reporting agency
  • Information we receive through our Customer Identification Program
  • Information about your transactions with us, our affiliates, or others


THE CONFIDENTIALITY, SECURITY AND INTEGRITY OF YOUR INFORMATION

We restrict access to information about you to those employees who need to know that information to provide products or services to you. We maintain physical, electronic, and procedural safeguards to protect this information.

Nonpublic Personal Information We Disclose. We may disclose the following kinds of nonpublic personal information about you:

  • Information we receive from you on applications or other forms, such as your name, address, social security number, assets, and income.
  • Information about your transactions with us, our affiliates, or others, such as your account balance, payment history, parties to transactions, and credit card usage.
  • Information we receive from a consumer reporting agency, such as your creditworthiness and credit history.

Parties to Whom We Disclose Nonpublic Personal Information. We disclose nonpublic personal information about you to the following types of third parties:

  • Financial service providers, such as mortgage bankers, securities broker-dealers, and insurance agents.
  • Non-financial companies, such as retailers, direct marketers, airlines, and publishers; and
  • Others, such as non-profit organizations.

We may also disclose nonpublic personal information about you to nonaffiliated third parties as permitted by law.

Information About Former Customers That We Disclose. If you become a former customer, we may disclose the following kinds of nonpublic personal information about you:

  • Information we receive from you on applications or other forms, such as your name, address, social security number, assets, and income.
  • Information about your transactions with us, our affiliates, or others, such as your account balance, payment history, parties to transactions, and credit card usage.
  • Information we receive from a consumer reporting agency, such as your creditworthiness and credit history.

Parties to Whom We Disclose Former Customer Information. If you become a former customer, we may disclose nonpublic personal information about you to the following types of third parties:

  • Financial service providers, such as mortgage bankers, securities broker-dealers, and insurance agents; and

  • Others, such as non-profit organizations.

We may also disclose nonpublic personal information about you to nonaffiliated third parties permitted by law.

Future Disclosure of Nonpublic Personal Information.

Joint Marketing/Service Provider Disclosure. We may disclose the following information to companies that perform marketing services on our behalf or to other financial institutions with whom we have joint marketing agreements:

  • Information we receive from you on applications or other forms, such as your name, address, social security number, assets, and income; and
  • Information about your transactions with us, our affiliates, or others, such as your account balance, payment history, parties to transactions, and credit card usage; and
  • Information we receive from a consumer reporting agency, such as your creditworthiness and credit history.

Fair Credit Reporting Act Information Sharing Opt Out. Under the Fair Credit Reporting Act, we have a right to share information regarding our transactions or experiences with you. Unless you instruct otherwise, we also have the right to share any other information about you with our affiliates (persons related by common ownership or affiliated by corporate control, now or in the future) either directly or indirectly. This other information may include, but is not limited to, application information, credit reports from a consumer reporting agency, and any other information we have about you. If you do not want us to share this information with our affiliates, you may utilize the opt out methods set forth below.

Opt Out Information

Financial Products or Services to Which Your Opt Out Applies. If you elect to opt out of information sharing we will treat that opt out as applying to all financial products or services that you have obtained from us in the past or that you may obtain from us in the future.

Your Right to Opt Out of Information Sharing. If you prefer that we not disclose nonpublic personal information about you or information not solely related to transactions or experiences with you to our affiliated companies or nonaffiliated third parties, you may opt out of those disclosures; that is, you may direct us not to make those disclosures (other than disclosures permitted by law).

We will treat an opt out direction by any joint account holder as applying to all parties on the account.

You may notify us of your intent to opt out of affiliate and nonaffiliate sharing by using one of the following methods.

How to Opt Out of Information Sharing. To opt out of sharing information with our affiliated companies and/or nonaffiliated third parties, you may call us at the following number: (800) 856-7905. To opt out of sharing information with our affiliated companies and/or nonaffiliated third parties, please complete and return the Notice of Intent to Opt Out to the following address: FIRST CALIFORNIA BANK, P.O. BOX 6017, CAMARILLO, CA 93011. To opt out of sharing information with our affiliated companies and/or nonaffiliated third parties, please complete and fax us the Notice of Intent to Opt Out at the following number: (800)958-2560.

If we do not receive notice of your intent to opt out of information sharing with our affiliated companies or nonaffiliated third parties within 30 days of delivery of this notice to you, we are authorized to disclose information about you to our affiliated companies or to nonaffiliated third parties, in accordance with our privacy policies and practices.

Notify Us of Inaccurate Information We Report To Consumer Reporting Agencies. Please notify us if we report any inaccurate information about your account(s) to a consumer reporting agency. Types of Affiliates

We may disclose information about you in the future to the following types of affiliates:

  • Financial service providers, such as:
    • Securities broker-dealers

Reasons for Disclosure

We may disclose information about you to our affiliates in the future to evaluate our total relationship with you and our family of companies, and give you the best price that relationship deserves.
